White Plains Drug Crime Defense Attorney

Criminal-Defense Focused Law Firm Serving Westchester County, NY

Both federal and state law regulate possession and other activities related to illegal narcotics, their precursor chemicals, and the unauthorized use of medical drugs without a prescription. In New York as well as the federal government, illegal drugs are categorized in Schedules based on their propensity for abuse and addiction and their medical value. Depending on what Schedule is involved in your drug arrest and the quantity found, you may be facing a misdemeanor or felony charge. In cases involving manufacture and/or trafficking, you may be facing federal charges after being investigated by the FBI or DEA.

No matter what type of arrest or investigation to which you are subject, your best chance of fighting back effectively for the most optimum outcome will lie with the quality of your legal representation. • Possession of marijuana

  • Possession of other controlled substances, such as heroin, cocaine, methamphetamine, Ecstasy, and all unauthorized medical drugs such as Vicodin, Xanax, Valium, Adderall, Fentanyl and more

The most dangerous narcotics, such as heroin, cocaine, methamphetamine, and more are classified as Schedule I drugs carrying the most severe penalties. Your charges and potential penalties in any drug arrest will vary greatly depending on which Schedule of drug is involved, the quantity found and whether it implies intent to sell, whether firearms were part of the alleged offense, and whether you have any prior convictions.

For example, you can be charged with a Class A-I felony which is the most serious if you are found with eight or more ounces of a drug classed as a narcotic punishable by 15 to 25 years in prison and fines of up to $100,000. Possession of two or more ounces of methamphetamine can result in a Class A-II felony punishable by three up to eight years in prison and fines of up to $50,000. Possession of 500 milligrams of cocaine is charged as a Class D felony punishable by up to seven years in prison and fines of up to $5,000.

Marijuana Charges in New York

Currently, possession of 28 grams or less of marijuana is a violation punishable by a fine of $50. Possession of 28 grams up to two ounces is also a violation punishable by a fine of $200. Quantities more than these found in your possession can lead to misdemeanor or felony charges. For example, if you are found with more than 10 pounds of marijuana, you can be charged with a felony carrying penalties of 15 years in prison and fines of up to $15,000.
