Drug Crime Penalties in NY

Class A-I Felony

For example, you can be charged with a Class A-I felony which is the most serious if you are found with eight or more ounces of a drug classed as a narcotic punishable by 15 to 25 years in prison and fines of up to $100,000.

Class A-II Felony

Possession of two or more ounces of methamphetamine can result in a Class A-II felony punishable by three up to eight years in prison and fines of up to $50,000. Possession of 500 milligrams of cocaine is charged as a Class D felony punishable by up to seven years in prison and fines of up to $5,000.

New York Marijuana Penalties

Currently, possession of 28 grams or less of marijuana is a violation punishable by a fine of $50. Possession of 28 grams up to two ounces is also a violation punishable by a fine of $200. Quantities more than these found in your possession can lead to misdemeanor or felony charges. For example, if you are found with more than 10 pounds of marijuana, you can be charged with a felony carrying penalties of 15 years in prison and fines of up to $15,000.
