New York State Misdemeanors & Felonies

There are two types of state crimes in New York: misdemeanors and felonies. As we have mentioned before, felonies are more serious than misdemeanors, which includes prison sentences rather than jail sentences.

The following are the misdemeanor penalties in New York:

  • Class A misdemeanor – Maximum jail sentence of 364 days and a fine not exceeding $1,000 (or double the amount obtained from the offense)

  • Class B misdemeanor – Maximum jail term of three months and a fine no more than $500 (or double the amount obtained from the offense)

  • Unclassified misdemeanor – Often given to traffic and other vehicle-related offenses, the penalties depend on the specific ordinance)

The felony penalties in New York include:

  • Class A-I felony – Maximum sentence of life imprisonment with a minimum term ranging from 15 to 25 years

  • Class A-II felony – Maximum sentence of life imprisonment with a minimum term ranging from three years to eight years and four months (or longer for a serious sex crime)

  • Class B felony – Maximum prison sentence of seven years and a minimum term ranging from one year to no more than one-third of the maximum sentence

  • Class C felony – Maximum prison sentence of 15 years and a minimum term ranging from one year to no more than one-third of the maximum sentence

  • Class D felony – Maximum prison sentence of seven years and a minimum term ranging from one year to no more than one-third of the maximum sentence

  • Class E felony – Maximum prison sentence of four years and a minimum term ranging from one year to no more than one-third of the maximum sentence.
