New York DWI Laws

In order to get charged with DWI in New York State, your blood alcohol content (BAC) must be .08 percent or higher, or there is other evidence of impairment. However, if you are a commercial driver’s license (CDL) holder, having a BAC of at least .04 can lead to a DWI arrest.

If your BAC is at least .18 percent, then you could be charged with Aggravated DWI. On the other hand, if your BAC is over .05 percent but less than .07 percent, you could be charged with driving while ability impaired by alcohol (DWAI-Alcohol).

If your driving ability was impaired by a single drug, you will be charged with DWAI-Drug. If your driving ability was impaired by a combination of alcohol and drugs, you will be charged with DWAI-Combination.

If you are under 21 years old and drive with a BAC of at least .02 percent, you will be charged with an underage DWI based one the state’s zero tolerance law.

DWI Penalties in New York

The following are the first-time penalties for all DWI-related offenses in New York:

  • DWI, DWAI-Drug & DWAI-Combination – Punishable by a jail term of up to one year, a maximum $1,000 fine, and driver’s license revocation for a minimum six months.
  • Aggravated DWI – Punishable by a jail sentence of up to one year, a maximum fine of $2,500, and driver’s license revocation for a minimum one year.
  • DWAI-Alcohol – Punishable by a jail term of up to 15 days, a maximum fine of $500, and driver’s license suspension for a maximum 90 days.
  • Underage DWI – Punishable by no jail time, a maximum fine of $125, and driver’s license suspension for up to three months.
